Terms, Conditions and Disclosures

Please see the Cabinet, Closet, and Material Agreements (if applicable) for additional
terms conditions and disclosures.

Manufacturer Warranty:
The Lifestyle Lab (TLL) shall deliver and assign to the Purchaser, without recourse, all
manufacturers and suppliers' warranties, if any covering such material. Purchasers may not change the drawings, plans, specifications, or items specified unless done so in writing to the dealer prior to ordering. Any modifications made on site that were not part of the final cabinet plan are non-warranted items. Any installer/installation errors are not covered under any warranty. All brand, model, style, color, etc. specific information in regard to warranty can be found on the manufacturers website or follow the product specific directions on acquiring warranty information.

Please follow these three steps to pursue a warranty claim to take place on your
damaged products
1: Before you sign delivery papers, provide detailed notes on the receipt or other
papers describing the damage. Be specific. Examples: damaged corners,
crushed left side of the skid, ripped box revealing scratched product, etc.
2: Take a picture(s) of any/all damage
3: Send us an email right away at office@thelifestylelabshowroom.com with your
name and address and describe the issue and attach your picture(s). We will
address any such damage as promptly as possible, TLL will aid in the process of
providing replacement or credit when appropriate and necessary if applicable. If
a replacement is needed, TLL will do our best to expedite it as soon as possible.
Packaging of materials may arrive with a different name and / or packaging due
to white labeling of products. If this is the case, you can reach out to us to verify
the SKU # and we can double check to make sure it is indeed the correct
material you are receiving. If a shipment is delivered that does not match this

We allow a 24-hour grace period after delivery to file any additional damage with
us. 

Order Delivery(s): 

You will need to verify your order and sign the shipping documents, confirming that
everything is received in good order. Conduct a thorough visual inspection of the
outside of the shipping boxes, pallets, and/or rolled goods. All issues must be noted in
detail on the driver's delivery receipt/paperwork at the time of delivery. You’ll need to retain your copy of the delivery paperwork that mentions any issues found at the delivery time. Refunds and replacements cannot be issued without damage
confirmation on the delivery receipt. If any non-visible problems are found, take pictures, and then email The Lifestyle Lab at office@thelifestylelabshowroom.com. Your order may be divided into multiple deliveries, possibly through different shipping companies, with the possibility of varying delivery dates. In the event your delivery is not made on the scheduled delivery date, contact us immediately to report missing items. 

Damaged Products Received 
Shipping or delivery damage, or delays cannot be anticipated. The Lifestyle Lab (TLL)
will not be held responsible financially or otherwise for damages or delays caused by
acts of God and/or any other unforeseen circumstances like illness, shutdown, war,
supply chain related issues, transit shipping delays or loss of product, cyber related
issues and/or other damages and delaying factors that could occur not listed herein.
TLL will make every effort to rectify any damage and/or delivery delays with the
manufacturer as soon as possible. If shipping damage is discovered, do not refuse the
delivery. You must note the issue(s) on the driver’s delivery receipt and contact TLL for
further directions and or instructions on best course of action. If you do not note damage on the drivers receipt, TLL will not be able to refund or replace any material damaged in transit eligible for a return, refund or exchange.

Delivery, Residential:
The Purchaser agrees to accept delivery of the product or products when delivered. It's possible the delivery could be broken into more than one shipment. The risk of loss,
damage or destruction by acts of God, shipping, theft or accidental shall be upon the
Purchaser upon delivery to the home. The purchaser agrees to inspect the boxes and to approve the receipt of delivery by signature. Delivery location is specific to the materials being delivered, delivery method, and company completing the delivery. The delivery specifications and requirements by shipper are solely the responsibility of the purchaser or receiving party to confirm and comply with delivery instructions, restrictions, and guidelines for fulfillment. Either a Lifestyle Lab representative or delivery transport contact will contact the designated party with a delivery window. You will be responsible for being there and coordinating your installer or contractor team to be at the residence during the delivery window. Drivers cannot enter the home and are not responsible for moving materials into the home.

Delivery, Business:

The purchaser agrees to accept delivery of the product or products as they become
available. It's possible that the shipment will arrive in one or more shipments.
Businesses must have a shipping dock or forklift on the property. The business must be open until 5pm local time. There is no prior delivery notification for commercial
deliveries. An adult must be at the place of delivery to accept and sign an acknowledgment receipt of the goods. The risk of loss, damage or destruction shall be upon the purchaser upon the delivery (by signature) of the product(s) to said business location.

Returns & Exchanges: (Not Including – Cabinet and/or Closet Materials)
Returns are accepted within 30 days of the purchase date and will be subject to a 25%
restocking fee of the total purchase price, or the minimum restocking fee of $500.00
witch ever is greater. All materials must be in their original, unopened packaging and in
unused, sellable, condition. Returns are not permitted and/or accepted on any opened,
used, or partial boxes, pallets, or orders.

Return Conditions: Tiles and Flooring must be securely packed for return shipping to
prevent breakage. The client is responsible for any return shipping costs unless the
return is due to damaged merchandise from the shipper/manufacturer.
In-Store Return: It is the responsibility of the purchasing party or their representative to
make arrangements to get products to the store location(s). For local clients, you can
bring the tile or flooring back to our showroom for processing. Please ensure you have
the original receipt and the RA number provided by our customer service team.

Refund Processing: Refunds will be processed within 7days of receiving and inspecting
the returned items. Exceptions: Custom or special-order tiles may not be eligible for
return unless there is a manufacturing defect. Damaged or Defective Tiles: If you
received damage or defective tiles or flooring, please contact us immediately.
Returns of non-standard items will be at the discretion of The Lifestyle Lab, our 3rd
party vendor or Shipper. Depending on the item, you may be required to pay for
shipping costs. Shipping costs will not be refunded. If you cannot deliver the product
back to us, you will be responsible for shipping the product back to us at your expense. 

Returned products must be unused, in original packaging, and prepared for return
according to our specifications to avoid damage in transit. Returns or exchanges are not honored on the following: Opened boxes, Special orders, closeouts, odd lots, Final
sales special deals, Some Flooring and Tile products Clearance items Transitions and
moldings Opened Grout Other items designated as custom and non-returnable.
Returns will not be accepted on any products or packaging damaged by the elements
(precipitation, humidity, temperature, or sun) or improper storage after shipping.
Exchanges can only be made for different options of the same product at the same
price point. Additional shipping and/or restocking fees may apply as described above.
Home Décor and Lighting Returns

If items are being shipped directly from our showroom or warehouse it will be a standard return. If items are being shipped by a 3rd party vendor or shipper, it will be a non-standard return. For Standard Returns, if you've decided you don't like what you ordered, no problem. Drop off your package at our Showroom and you will receive a full refund for your item(s). In the event that you have thrown away your original packaging, please note that we are unable to provide additional return packaging. Items must be in their original packaging and unused to be returned. If you need to ship the product back, shipping will be the purchaser’s responsibility and once received we will issue you a refund back to the original form of payment les any associated restocking fees (if applicable) or any other form of penalties (if applicable).

Defective or Damaged Items (home décor)
If you receive a defective or damaged product, please contact The Lifestyle Lab (TLL)
as soon as possible. TLL will work on your behalf with the supplier and shipping partner
to correct the order. If the item is no longer available TLL will issue a full refund to the
original form of payment in 3-7 business days. Shipping and ETA will depend on the
products’ availability.

Order Cancelations:
The Lifestyle Lab has the right to cancel any order for any reason. Refunds for orders
canceled that are initiated by TLL will be processed within 7-10 business days. The
purchaser will be responsible for any cancellation fees from the manufacturer, or
suppliers. Those fees if any will be deducted from the total refund amount back to the
purchaser.

Cabinet and Closet Material Returns and/or Exchanges:
Returns and/or Exchanges are not permitted on any closet or cabinet orders no
exceptions. This policy applies to all additional materials sold in conjunction or as an
addition to the cabinet(s) or closet(s). These items can include but are not limited to
trim, scribe, fillers, toe kicks, moldings, etc. Hardware such as knobs, pulls, and decretive hardware purchased for cabinets and/or closets may be returned and/or exchanged. Hardware is subject to the same rules and regulations set forth in the material returns.

Cabinet and Closet Change Orders:

Should purchaser(s) request a change order for additional material(s) needed due to job related changes not provided prior to ordering per the final designed and approved plan, these extra materials will be billed and invoiced accordingly. The purchaser takes full responsibility for any change orders and what delays they may cause.

Default / Cancellation:
The Purchaser understands that the products described are specifically designed and
custom built and that TLL takes immediate steps upon execution of this Agreement to
design, order and virtually construct those items set forth herein. Accordingly, this
agreement is not subject to cancellation by the Purchaser for any reason. In the event
that Purchaser attempts to cancel this agreement or otherwise defaults in the
performance of Purchaser's obligations hereunder, TLL may, at TLL's option, cancel this Agreement and retain as liquidated damages, and not as a penalty, all amounts paid by Purchaser. Alternatively, TLL shall have the right to pursue any legal and equitable remedies available to it, including specific performance. Notwithstanding anything to the contrary set forth above, in the event of Purchaser's default, TLL shall have the right to stop performance hereunder until such time as Purchaser cures the default.

Shipping / Storage:
ETA of cabinetry will be given as an estimated date at the time of order. Once the
cabinetry is through production the cabinet designer will relay the estimated eta and
cabinet delivery to the designated address to you via email and coordinate the best
days and times to accept delivery. Delivery and shipping from the manufacturer to you
could incur delays which are out of TLL control. TLL is not responsible for any delays,
hardships, or costs associated with any shipping delays. TLL is not responsible for any
damage to the product(s) during manufacturing, shipping or delivery. TLL will make
every effort to rectify any damage as soon as possible. TLL gives no guarantees on
timing of deliveries of material(s). TLL will whenever possible notify the customer of
delivery changes and/or schedule delays due to weather or supplier delays. No
remuneration or refunds will be given due to timing delays.

Shipment Storage or Storage of Goods:

The Lifestyle Lab (TLL) is not responsible for any accrued storage fees or penalties
imposed by a shipper or receiving company or yard for any goods being picked up,
retrieved, or obtained directly from a receiving yard or company by the purchaser or
designated party. TLL does not provide storage materials in any fashion. If you have
purchased home décor or a previously arranged shipment of your order to arrive at the
TLL location, you will have 3 business days from the date of arrival notification to
retrieve your order from our location and/or make arrangements for delivery.
TLL can provide delivery of small orders and goods from our location to your residence
for an additional fee. The parameters surrounding the delivery, including any applicable
fees will be outlined in a separate document provided to you at the time of purchase.
The delivery services is subject to all applicable terms and conditions listed. The
delivery service document may include additional details and/or restrictions specific to
the delivery.

Private or Special Event Ticking
Event tickets are non-returnable and non-refundable.

Dispute Resolution:
The Parties shall attempt in good faith to negotiate a settlement to any dispute between them arising out or in connection with this Agreement within twenty (20) working days of either Party notifying the other of the dispute. All or any unresolved dispute or controversy or claim from or under this Agreement arising out of touching upon or in relation to the terms and conditions of this Agreement, including the interpretation and validity of the terms thereof and the respective rights and obligations of the Parties and any unresolved controversy or claim arising from the terms of this Agreement shall be settled by binding arbitration under the laws and jurisdiction of the State of Arizona.
